Disclaimer
- These terms of use only apply to premade adoptable characters, or characters that belong to my original species. Commissioning me to bring a character idea to life generally goes under the same ToS as my usual commissions.
- If I do not say breaking a specific part of these terms will result in legal action, then it will result in simply being privately blacklisted from buying future designs from me instead.
- I may decline selling to any client for any reason, including but not necessarily limited to: bigotry, zoophilia, pedophilia, or a known history of attempting to ban users from PayPal/Stripe.
- Any commission inquiries sent to me involving a premade character I designed will be eligible for a $5 or 10% discount off of the total price! Whichever one is a bigger discount will apply. (Custom-made characters, such as commissioned character designs, will qualify for the discount too if I am given a lot of artistic freedom. If you have a very exact idea of a character and ask for me to make a ref, you do not qualify for a discount.)
- Despite the amount of text, my ToS is largely covering edge cases. These terms should be quite loose in general. Let me know if you have any questions.
Usage Rules
- I have no control over what you do with an adoptable, because it is no longer my character after ownership rights have been transferred, it is yours. I will pursue legal action against you if you:
- claim you drew the original art, created the original design, or created one of my original species
- Use one of my original species for any commercial purpose that may result in the species becoming trademarked
- Small-scale merch is okay, as long as I am credited for the species.
- You are free to change a character away from my species if you want to use them for a film or a video game.
- Use the original art for commercial purposes without negotiation of royalties (Unless the character is from an original species of mine, you automatically acquire commercial rights to the design itself upon adoption as long as my art isn’t used commercially.)
- There is no need to post that I designed the original character in every submission, only if somebody asks. In SFW reference sheets I would like to be credited for the character’s design either in the art itself or in the description, but this isn’t required.
- NSFW/fetish content of characters received from me or characters from my original species is completely fine. You don’t need to ask me if X or Y fetish is okay, it’s your character. However, I would prefer not to be mentioned as the character designer in the descriptions of NSFW art.
- I would also prefer that, should my original species be named at all in the description or tags of NSFW art, you mark it as adult and tag all kinks in the image properly so people can have a chance to avoid NSFW/fetish content when searching for my species.
Editing Rules
- Drastically altering a design is okay. If it goes far beyond a simple change such as changing a marking or keeping the design intact as another species, you don’t need to credit me anymore for the design, and you can resell the original design.
- Ask me first before doing this so I can let you know whether the design is too different.
- This is likely to disqualify you from the discount I give for characters I designed.
- Additional characters (such as extremely similar family members, making the same design into a set of twins/clones) that are heavily based on the original design are okay for the buyer to create/commission an artist to create, or co-own with a friend.
- Please sell all related characters together if no party wishes to own them anymore.
- Not required, but I would appreciate being notified of these characters’ creation, should they not belong to the original buyer, just so I’m aware an unrelated party isn’t trying to make a copy of a character I sold to a client.
- I am okay with recoloring the character and editing the text on the original reference for an extra fee to help out.
Buying & Selling
- I would prefer if my designs were not resold for more than I sell them for myself, unless more value is added in the form of artwork, but I can’t stop you.
- If the design has NSFW/fetish art drawn of it, do not allow the design to belong to anyone under the age of 18, or who is unaware of the contents of the art.
- If the client forces a refund for an adoptable after I send over files, I will retake ownership rights and sell it to somebody else, since the agreement is broken at that point.
- This is the only instance I have the power to retake ownership rights – you bought the character, I’m not loaning it to you. Even if I do not personally approve of a client’s actions, I cannot take the character back, but I may privately blacklist the client.
- I may make a beware post in the event of a chargeback, or if a client attempts to associate me, the character creator, with harmful views and content.
- If the client co-owns a design (including twin characters/recolors), I cannot be involved in any disputes.
Toyhouse Guidelines
If you have a toyhou.se account, please credit me as the creator if:
- You acquire a premade adoptable from me and make it into its own character
- You give me full artistic freedom on making a design for you (i.e. “Just make a fox for me however you want, here’s a moodboard”)
Please credit me as a designer instead if:
- You use an adoptable from me to revamp an existing OC
- You have a very specific OC idea in mind and commission me to draw it
Rennekin is my account for keeping characters sold to offsite users on the site so I can have them visible in my designs page, which I use as a sort of portfolio for the varied designs I have made. I can send them to you upon request if you get a code, or delete them if you do not want your character there. I have the owner of each design listed, so it may be best to let them know of the character’s site entry if sold/traded, and me know so I can update credits accordingly.
